CDM Regulations shake-up and JCLI
Contract Revisions
The changes to the
Construction (Design and Management) (CDM) Regulations (1994) will have
significant impact on landscape professionals and contractors.
The new CDM Regulations 2007
came into force on 6 April and will revise and bring together the existing CDM
Regulations 1994 and the Construction (Health Safety and Welfare) Regulations
1996 into a single regulatory package.
The JCLI Agreement for
Landscape Works has been withdrawn because it conflicts with the revised CDM
Regulation 2007. JCLI Practice Note No 6
(April 2007), [Download] advises on the interim use
of the JCT Minor Works Building Contract 2005 (with its Amendment 1 of April
2007) for landscape construction projects.
It is intended that a new Edition of the JCLI Agreement for Landscape
Works will be available by the autumn of 2007.
